Terms of Use
These terms govern your use of ecgprod.com. A signed production agreement, estimate, statement of work, release, or other written agreement controls the actual services ECG performs.
Effective and last updated: July 15, 2026
1. Acceptance and eligibility
These Terms of Use (Terms) are a binding agreement between you and Entertainment Creative Group Productions, Inc., doing business as ECG Productions (ECG). By accessing or using ecgprod.com, its forms, planning tools, media, or automated features (collectively, the Site), you agree to these Terms and the Privacy Policy. If you use the Site for an organization, you represent that you have authority to act for it.
You must be at least 18 years old, or the age of legal majority where you live, to submit a project inquiry or form a contract through communications that follow.
2. Website information is not a production agreement
The Site provides general information about ECG, examples of past work, educational content, planning tools, and ways to begin a conversation. Submitting a form, using a calculator, receiving an automated response, or discussing a possible project does not obligate either party, reserve dates, transfer rights, or create a production-services contract.
Services begin only under an agreement authorized by ECG that defines scope, deliverables, fees, payment schedule, dates, revisions, approvals, expenses, cancellation, rights, releases, licensing, and other project-specific terms. That agreement controls if it conflicts with these website Terms.
3. Estimates, pricing, schedules, and availability
Website package descriptions, budget-planner outputs, ranges, examples, timelines, and availability statements are informational and not binding offers. Production costs and timing depend on creative scope, crew, talent, locations, travel, equipment, insurance, rights, media use, revisions, versions, approvals, taxes, and third-party expenses. A written estimate or agreement may expire or change when assumptions change.
4. ECG content and intellectual property
Unless otherwise identified, ECG or its licensors own the Site's text, design, branding, software, graphics, photographs, videos, audio, showreels, case studies, and compilations. Client names, marks, footage, music, and other portfolio elements may belong to their respective owners and appear only for approved showcase or informational use.
ECG grants you a limited, revocable, nonexclusive, nontransferable license to view and use the Site for lawful personal or internal business evaluation. You may not copy, download, scrape, republish, train a model on, sell, modify, remove rights notices from, or commercially exploit Site content without written permission or a legal right to do so.
5. Your inquiries and submitted materials
You keep ownership of materials you submit. You grant ECG and its service providers a limited license to host, copy, analyze, transmit, and use those materials as reasonably necessary to review and respond to your request, protect the Site, and provide requested services. This license ends when the information is no longer reasonably needed, subject to legal, security, backup, and recordkeeping requirements.
- You represent that you have the right to submit the material and that doing so does not violate another person's rights or law.
- Do not submit confidential scripts, unreleased campaigns, trade secrets, sensitive personal data, credentials, or regulated information before ECG agrees to an appropriate confidential method or nondisclosure agreement.
- Do not submit unlawful, infringing, deceptive, malicious, or abusive content.
A project inquiry is not treated as confidential merely because it is submitted through the public Site.
6. Acceptable use
You may not use the Site to:
- Break law, infringe rights, impersonate another person, or misrepresent authority.
- Probe or bypass security, authentication, rate limits, or access controls.
- Introduce malware, automate abusive requests, interfere with operation, or overload infrastructure.
- Harvest personal information, send spam, or use Site data for surveillance or unlawful profiling.
- Reverse engineer Site software except where a nonwaivable law expressly permits it.
ECG may restrict or block access reasonably believed to violate these Terms or threaten users, systems, or rights.
7. Automated and AI-assisted features
The Site may use automated systems to detect abuse, route inquiries, summarize project context, suggest questions, or draft staff follow-up. Automated output can be incomplete or incorrect and should not be treated as a quote, acceptance, professional advice, or final ECG decision. ECG personnel retain authority over client selection, pricing, scope, rights, and commitments.
8. Third-party services and links
The Site may link to or load services operated by Vimeo, YouTube, Google, social networks, scheduling providers, or other third parties. Their terms and privacy practices govern their services. ECG does not control third-party availability, security, content, or changes and is not responsible for them merely because the Site links to or embeds them.
9. Disclaimers
To the fullest extent permitted by law, the Site is provided as is and as available. ECG disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. ECG does not warrant uninterrupted operation, error-free content, availability of any project date, or a particular creative, business, search, marketing, or financial result. Some jurisdictions do not allow certain exclusions, so they may not apply to you.
Site articles and tools provide general production information, not legal, tax, accounting, medical, or other regulated professional advice.
10. Limitation of liability
To the fullest extent permitted by law, ECG and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from Site use, including lost profits, lost data, business interruption, or reputational harm. ECG's aggregate liability arising solely from the Site will not exceed the greater of $100 or the amount you paid ECG specifically for Site access during the twelve months before the event. These limits do not apply where law prohibits them or to liability that cannot legally be limited. Project-service liability is governed by the applicable signed agreement.
11. Indemnity
To the extent permitted by law, you will defend and indemnify ECG from third-party claims, damages, and reasonable costs arising from your unlawful Site use, your submitted material, or your material breach of these Terms. This provision does not require indemnity for ECG's own unlawful conduct and may be limited by applicable law.
12. Governing law and disputes
Georgia law governs these Terms without regard to conflict-of-law rules, except where consumer law requires another result. Any dispute concerning only the Site will be brought in the state or federal courts serving Fulton County, Georgia, and each party consents to their jurisdiction. Before filing, the parties should first attempt in good faith to resolve the issue by written notice. A separate signed project agreement may provide different dispute terms.
13. Changes and general terms
ECG may update these Terms prospectively. Material changes will be identified by a revised effective date. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. ECG's failure to enforce a provision is not a waiver. You may not transfer these Terms without ECG's consent; ECG may transfer them as part of a reorganization, financing, or sale of relevant business assets.
